What is a Durable Power of Attorney (POA)?
It is a legal document that is put in place if a person 18 or older is not able to make decisions on their own due to incompetency, an accident, or other impairment. The trustworthy person they have assigned as their agent is able to take over all business matters on their behalf. If there is no POA in place and the person is 18 or over and becomes unable to reasonably care for their financial responsibilities, then they can have the courts take over and they will be assigned a state conservator.
